These terms govern your use of the GiftCourier app ("the app") on your Shopify store. Installing the app means you accept them. If you do not accept them, uninstall the app.
1. What the app does
GiftCourier lets a gift-card buyer nominate a recipient, write a message and choose a delivery date. On that date the app creates a Shopify gift card on your store and emails it to the recipient in your branding.
The gift card is created on the delivery date, not at purchase. Before creating it the app re-checks that the order has not been refunded or cancelled, and creates nothing if it has.
2. Your responsibilities
- You are the merchant of record for every gift card sold through your store. The gift card is a liability of your business, not ours.
- You are responsible for the accuracy of what you configure: the product tag, the per-gift-card value ceiling, your branding and your sender details.
- You are responsible for your own compliance with the law that applies to gift cards where you sell them, including expiry, escheatment and disclosure rules. We do not give legal, tax or accounting advice.
- You must not use the app to send unsolicited bulk email or anything other than gift cards your customers have bought.
3. Our responsibilities
- We will make reasonable efforts to deliver each gift card on the date chosen, and to surface failures to you promptly when they occur.
- We will handle personal data as described in our Privacy Policy and the Data Processing Addendum, both at giftcourier.app.
- We will give you reasonable notice of material changes to these terms or to the app's behaviour.
4. What we do not promise
The app depends on Shopify's APIs, our email provider and the public internet, none of which we control. We do not guarantee uninterrupted service or that every email reaches every inbox. Email delivery in particular can fail for reasons entirely outside our control: a recipient's mailbox can be full, a spam filter can silently discard a message, an address can be mistyped by the buyer.
The app is provided "as is" to the fullest extent the law allows.
5. Fees
Pricing is as shown on the app's listing and is billed by Shopify through Shopify App Pricing. Shopify handles charges, refunds, trials and plan changes; we do not process your payment details and never see them.
A free tier is a real tier, not a trial. Its monthly limit is enforced in the app, and a gift card beyond it is held, not refused. The order stands, the money is yours, and the gift card is released if you upgrade.
6. Suspension and termination
- You may uninstall at any time. Uninstalling stops all future deliveries.
- On uninstall, Shopify sends us a
shop/redactrequest and we delete your store's data as described in the Privacy Policy. This is not reversible, and pending gift cards are cancelled. - We may suspend an account that is using the app to send email that is not a gift card a customer bought, or that puts our email sending reputation at risk. Where circumstances allow, we will contact you first.
7. Liability
To the fullest extent permitted by law, our total liability arising out of or relating to the app is limited to the fees you paid us in the twelve months before the claim. We are not liable for indirect or consequential loss, including lost sales or lost goodwill.
Nothing in these terms limits liability that cannot lawfully be limited.
8. Changes
We will update this page and the "last updated" date when these terms change materially, and tell you through the app.
9. Governing law
These terms are governed by the laws of the State of New Jersey, USA, without regard to its conflict-of-law rules.
